Terms of Use

KaiPlay

These Terms of Use (the “Terms”, together with the app-store licence below, the end-user licence agreement or “EULA”) govern your use of KaiPlay (formerly BabyVocab), a child-focused vocabulary app developed by Kaifuz Studio (“Kaifuz Studio”, “we”, “us”). KaiPlay is intended for young children and their parents. It is meant to be set up and supervised by a parent or legal guardian, who accepts these Terms on behalf of themselves and any child who uses the app. By downloading, installing or using KaiPlay you agree to these Terms. If you do not agree, do not use the app.

The licence we grant you

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use KaiPlay on devices you own or control, for personal, non-commercial family use. You may not sell, rent, sublicense or redistribute the app; reverse-engineer, decompile or disassemble it except to the extent the law expressly permits; or remove any proprietary notices. All rights not expressly granted are reserved by Kaifuz Studio.

Parental responsibility and supervision

Settings and any external links are behind a parent gate. Parents and guardians are responsible for setting up the app, supervising their child’s use, and deciding what is appropriate for their child. KaiPlay is a learning toy, not a substitute for supervision.

No in-app purchases, no ads

KaiPlay contains no in-app purchases, no subscriptions, and no advertising. There are no purchase triggers accessible to children. If a paid feature is ever introduced, it would be gated behind the parent gate, sold and processed by Apple’s App Store or Google Play, and its terms would be stated at the point of purchase and added here.

Children’s privacy

KaiPlay is built with COPPA principles in mind and does not knowingly collect personal information from children. How the app handles data is described in the KaiPlay Privacy Policy, which forms part of these Terms.

Acceptable use

Use KaiPlay lawfully and for its intended learning purpose. Do not attempt to circumvent the parent gate, reverse-engineer the app, or use it in any way that could harm a child or another person.

App-store terms

Your use is also subject to the rules of the store you downloaded from. For Apple, the standard Licensed Application End User License Agreement applies and, where it conflicts with these Terms, governs the Apple-provided licence. Apple and Google are not parties to these Terms and are not responsible for the app or its support, but a store may enforce these Terms as a third-party beneficiary.

Disclaimers and limitation of liability

KaiPlay is provided “as is” and “as available”, without warranties of any kind to the fullest extent the law allows. To the fullest extent permitted by law, Kaifuz Studio will not be liable for indirect, incidental, special or consequential damages arising from use of the app. Nothing here excludes liability that cannot be excluded by law, and some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

Termination

You may stop using KaiPlay at any time by deleting it. We may end the licence if these Terms are materially breached. Licence restrictions, disclaimers and the limitation of liability survive termination.

Changes to these Terms

We may update these Terms as the app changes. The date above shows when they were last revised; continuing to use KaiPlay after an update means you accept the revised Terms.

Governing law

These Terms are governed by the laws applicable at Kaifuz Studio’s principal place of business, without regard to conflict-of-laws rules, and subject to any mandatory consumer protections of your country of residence.
