Terms of Use

These Terms of Use (the “Terms”, together with the app-store licence below, the end-user licence agreement or “EULA”) govern your use of KaiCam, a camera-control app developed by Kaifuz Studio (“Kaifuz Studio”, “we”, “us”). By downloading, installing or using KaiCam you agree to these Terms. If you do not agree, do not use the app.

The licence we grant you

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use KaiCam on devices you own or control, for your own personal, non-commercial use. You may not sell, rent, sublicense or redistribute the app; reverse-engineer, decompile or disassemble it except to the extent the law expressly permits; or remove any proprietary notices. All rights not expressly granted are reserved by Kaifuz Studio.

Acceptable use and your equipment

KaiCam uses camera, Bluetooth and local-network access to connect to and control a camera you own. You are responsible for using it lawfully, for the footage you capture, and for complying with the terms and firmware of the connected hardware. Do not use KaiCam to record people or places where you have no right to, to access devices that are not yours, or to circumvent any device security.

Purchases

KaiCam does not currently sell in-app purchases or subscriptions. If paid features are added in the future, they will be sold and processed by Apple’s App Store or Google Play — we will never see your card or billing details — and their specific terms, including any renewal and cancellation rules, will be stated at the point of purchase and added here.

App-store terms

Your use is also subject to the rules of the store you downloaded from. For Apple, the standard Licensed Application End User License Agreement applies and, where it conflicts with these Terms, governs the Apple-provided licence. Apple and Google are not parties to these Terms and are not responsible for the app or its support, but a store may enforce these Terms as a third-party beneficiary.

Privacy

Our handling of your data is described in the KaiCam Privacy Policy, which forms part of these Terms.

Disclaimers and limitation of liability

KaiCam is provided “as is” and “as available”, without warranties of any kind to the fullest extent the law allows; we do not warrant compatibility with any particular camera or that a connection will be uninterrupted. To the fullest extent permitted by law, Kaifuz Studio will not be liable for indirect, incidental, special or consequential damages, or for lost footage, arising from your use of the app. Nothing here excludes liability that cannot be excluded by law, and some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

Termination

You may stop using KaiCam at any time by deleting it. We may end your licence if you materially breach these Terms. Licence restrictions, disclaimers and the limitation of liability survive termination.

Changes to these Terms

We may update these Terms as the app changes. The date above shows when they were last revised; continuing to use KaiCam after an update means you accept the revised Terms.

Governing law

These Terms are governed by the laws applicable at Kaifuz Studio’s principal place of business, without regard to conflict-of-laws rules, and subject to any mandatory consumer protections of your country of residence.
